March 19, 2020 – Executive Order No. 202.7. New York Governor Andrew Cuomo signs an Executive Order allowing for documents to be notarized virtually using audio visual technology.
What this means for you?
With visitors now not being allowed to attend nursing homes, powers of attorneys are unable to be completed.
How is this a problem?
A proposed agent under a power of attorney cannot be appointed to handle the financial affairs of their loved ones who are locked in a nursing facility.
Why is this executive order important?
It allows a notary public to provide notarial services that is required for a power of attorney, without having to be present in the nursing home. It is now sufficient for the notary public to provide a notarial act through audio visual means.
